We’re Thorough in Our Investigation
Our dedicated attorneys and talented staff will drill down into the circumstances of the traffic stop and the sobriety test. Was there reasonable suspicion for the police to even pull the driver over to begin with? We’ll find out. Did the arresting officer have probable cause to administer a sobriety test? We’ll investigate everything from the police reports to the dash cam footage of the traffic stop. If law enforcement failed to follow proper procedure at any step of this process, it may be possible to have all the evidence from the traffic stop and sobriety test thrown out. And in a DUI case, that’s usually tantamount to having the case itself dismissed.
Even if the police followed correct procedure and respected a person’s constitutional rights, there are still more ways than commonly realized for the sobriety test itself to be wrong. Breathalyzer equipment has strict rules for how it has to be maintained, for the purposes of accuracy. We’ll make sure that maintenance work is being done and documented.
We’ll also spend time with our client and find out more about their own physical condition and the events leading up to the arrest. Were they eating bread or sugar products? These can cause blood alcohol content level readings to spike, but it certainly doesn’t mean our client was intoxicated. Do they have commonplace health conditions like acid reflux, or and take medication for it? Both the condition, as well as prescribed medication for this, another ailments, can cause a “false high” on the blood alcohol content level.
If the sobriety test was done by drawing blood, our investigative process will include making sure chain of custody rules were followed in the handling of the sample. Blood that’s improperly stored can ferment in a way that increased blood alcohol content levels.
